The products are offered for sale as long as they are still available via the Devederm Shop but within the limits of available stocks.

The products offered for sale via the Terra Humana Shop comply with French legislation and enjoy all legal guarantees.
The products offered through the Shop also have a commercial guarantee.
Devederm may not be held liable in any way whatsoever and on any grounds whatsoever if the product does not conform to foreign legislation.
Any Customer wishing to import, export or use outside French territory any of the products offered through the Terra Humana Shop, must first ensure under his sole responsibility that the product complies with the legislation in force that could apply.

The final confirmation of the order forms the contract of sale between Devederm and the Customer relating to the product(s) ordered.

The general conditions of sale in force at the time of the order and the receipt of the order are kept by Devederm for a period of ten years from delivery of the order.
The Customer may obtain a digital copy on request.

All orders are payable in Euros, all taxes and mandatory contributions included. Any bank charges (such as exchange commissions) are charged to the Customer (including in the case of a refund).
The Client has the following possible means of payment:

- Payment by credit card via the secure online payment established and operated under the responsibility of BNP PARISBAS.
- Payment by cheque
- Payment by bank transfer

Products ordered and paid for will be shipped to the Customer at the delivery address specified by him with the order, in the shortest time possible and no later than thirty days after the complete payment for the order, which is:

- Immediate when paying by bank transfer or domestic credit card (because payments by foreign cards can give rise to a special authentication or verification procedure that slows down the processing of the order)
- Deferred in the event of payment by cheque. The shipping fees indicated when ordering are charged to the Customer.

In the event of delivery outside French territory, the Customer must also pay any taxes and customs duties that may be applicable. Devederm is never under any obligation to check and inform the client of any tax and customs duties that may be applicable. This verification is the responsibility of the Customer.

In the event of unavailability of the product ordered by the Customer, the latter will be informed as soon as possible and the amounts paid for the purchase of the said product will be reimbursed at the latest within thirty days of such payment. Reimbursement will be made by cheque in Euros sent in favour of the Customer and, in the absence of any other indications, to the invoice address indicated on the order or by bank transfer if the Customer gives Devederm his bank details.
Devederm may not be held responsible for the delivery and its timing : The customer acknowledges correct receipt of the package with his signature.
Failure or a delay in delivery due to the specific supplier is the latter's responsibility.

For orders whose shipping address is located in Continental France, delivery charges are free to the Customer if the amount of the order is greater than or equal to 25 € all taxes included.
If the amount of the Customer order is less than 25 € all taxes included, a common delivery tariff appliess in Continental France, i.e. 5.90 € all taxes included.

For orders whose shipping address is located outside Continental France, a minimum order of 50 € all taxes included is required.
The table below summarizes the delivery rates depending on the country of delivery:

The Customer has a right of cancellation of seven working days following receipt of the product ordered.
The exercise of this right is subject to no justification and no penalty.
The Customer must pay, however, the cost of returning the product.
The return of the product should be done after validation and authorization by Devederm, returns should be preceded by a registered letter indicating the cancellation by the client.
In this case, the product should be returned to the following address: Laboratories Devederm, Terra Humana Shop, 116 Route de Paris - 69260 CHARBONIERES LES BAINS in perfect condition in its original packaging and undamaged with all accessories, instructions, guarantee and a copy of the invoice.

If the Customer correctly exercises this right of cancellation, Devederm will refund the Customer the amounts paid corresponding to the acquisition of the product(s) returned within a maximum period of thirty days, by cheque sent in Euros in favour of the Customer and, in the absence of any other indications, to the invoice address indicated on the order or by bank transfer if the Customer gives Devederm their bank details.

Pursuant to Act No. 2004-801 of 6 August 2004 with respect to the protection of personal data and amending the Act No. 78-17 of 6 January 1978 relating to information technology, data files and liberties :

The Customer is informed that personal data concerning him and input by him when ordering is subject to information processing in order to process the order.
These data may also be used for follow-up business, in particular so that the Customer may be informed especially by email of commercial offerings of the Terra Humana Shop.
The Customer may, however, refuse this follow-up:
- Either at the moment of ordering by checking the box offering him this possibility;
- Or, failing this, by explicitly informing Devederm via the email address made available to him for this purpose on any follow-up medium, especially e-mail, that may be addressed to him.

Devederm is responsible for this processing that has been declared to the French National Commission for Information Technology and Civil Liberties.
This does not concern, however, the processing of data provided to the banking service designated by Devederm to handle the payment of credit card orders securely. Only this service provider is responsible for processing this data.
The Customer is also advised that the failure to input the personal data requested in the mandatory ordering process described above prevents proper ordering.
The essential data are those data whose input field is indicated by an asterisk.

This contract is subject to French law. The language of this contract is the French language. If the contract is translated into a foreign language, only the French version is legally binding.

In the event of a dispute, French courts will have sole jurisdiction. In case of a dispute with a trader, only the commercial courts with jurisdiction over the headquarters of Devederm will be competent.
